What is the "National Interest Waiver"?

While persons with advanced degrees need both a job offer and a Labor Certification to qualify for the EB-2 immigration visa, both can be waived in case the applicant's work is of "national interest" to the U.S.

This is rather a political term - U.S. authorities have not clearly defined this term.

In general, a "National Interest Waiver" is granted in case the applicant's work

  • contributes to the improvement of the American economy
  • improves the wages and working conditions of U.S. employees
  • improves training and advanced training programs for American children and low-qualified workers
  • improves the U.S. health system
  • creates affordable living space for young and/or old and poor U.S. citizens
  • helps the American environment and makes more effective use of natural resources

The EB-2 National Interest Waiver Application is to be submitted to the appropriate USCIS Service Center.
