What requirements does the company have to meet?
L-1 transfers are only possible, if the foreign organization and the U.S. organization are in a "qualifying relationship".
There must be equity links between the U.S. organization and the foreign organization, or both organizations must be owned/controlled by the same person or legal entity. Whether the parent company is based in the U.S. or abroad is irrelevant.
Transfers are possible between:
- parent company and subsidiary
- subsidiary and parent company
- affiliated company and affiliated company
A U.S. sales office or a simple cooperation with a U.S. company is not sufficient for the L-1 visa category.
